I believe these warnings are to prevent damage that might occur by plugging the 8022 in while the power is on. This is the case for any condenser. My guess is that it works fine on phantom power

regarding those cue points, MP3 DC only creates them automatically for equal time intervals, such as creating hour long cue points in a radio program. it does not check for silence between songs
