This poor guy has had a fight for 16 years with his
neighbor about his tower.
Legislation in Sweden doesn't demand a special permit to install a tower for a
ham, but this neighbor of his is an active politician and he managed to get the city to disregard the law and create their own laws.
The neighbor complained that there might be interference - being asked if it
had ever happened, he admitted it had not. He was also afraid of the radiation!
The tower was "ugly" to look at - he couldn't see the antenna, it was
higher up, at 60 feet. They forced SM5CMM to remove his tower. SM5CMM then
mounted his beam on a 30 feet tube, just above the roof. His
"winning" neighbor can now look at the antenna from his kitchen
window and be more exposed to the supposedly "dangerous" radiation.
Love thy neighbor! Hi!
The photos show SM5CMM´s antenna. The tower which he was compelled to remove is
to the left and now instead his neighbor will get a close view of the antenna. You win the battle, but you lose the war,
isn't that what they say?

SM7WT
My own situation was more or less
the same. In 1985, I made the drawings for my tower and went to the local
authorities to ask if they were good enough for a building permit. I was told
that no building permit was needed so I went home and installed my tower. Our
neighbor filed a complaint and one day, I got a letter from the local
authorities that I had installed "an illegal radio tower." After
spending several hours writing an explanation and waiting nervously for months,
I finally got a confirmation from the politicians (!) that no building permit
was needed. This is the only time in my life, I can be grateful for something,
done by politicians! My neighbor continued to complain about TVI, well aware
that the problem was caused by his broad-band amplifier, (produced in Germany,
not allowed to be sold in Germany and installed by a German born
"technician.") My neighbor didn't allow me to fix the problem and
preferred to call me to complain every time I was active. Eventually he
contacted the FCC and after their measurements, they told him that I did not
transmit any false signals and since he didn't want me to help him, he had to
go somewhere else for help. In the past the FCC would solve interference
problems, but today they just check the transmitted signal.

....So a move to the village of Elkesley,( IO93MG )
where I applied for a Mast for the 2 Cushcraft beams.... problems...
Quote from the Local Council Planning.... "Refused.... a mast being
considered as a Dominant feature in a Residential Area, and Detrimental to the
Visual Amenities of my neighbours".
In plain English," No, you can't have a mast because they are
unsightly"
A little digging into the Planning Act in a Book in the local Library... some
hours spent with the help of a Head Planning Officer from the next County, and
a letter was sent to the Solicitor for my Local Council, who said I did not
even need to APPLY for permission to put a mast up.... If it was mounted on a
TRAILER.....!
Easy now... 80 FEET ( about 25 meters) mast on a trailer, 4 X times 19 element
Cushcraft stacked and bayed.... I'm in business again ... and NOBODY can stop
me, lots of efforts to get the antennas taken down, but as the LEGAL situation
was... there was nothing that anyone could do to remove the mast and antennas,
they were mounted on a Commercial trailer that I had modified with extra
outriggers to spread the wind loading of the Beams. G6YEP is back with a
VENGEANCE...
Lots of hams in the UK were given the same advice, if you have problems with
the Planning for a FIXED mast, ask the Council Solicitor for a LEGAL
determination for a trailer mounted mast... no planning required because it can
be moved, so it is NOT permanently sited, this may apply for other Countries as
well .... certainly worth looking into if you have Planning objections to a
fixed mast.
F8IJV
... I got
all the troubles in the world to put up a small 12 meters high tower supporting
a 10 M 5 elements yagi in my parents's home. From 1995 to the end of 1999, I've
been sued before the justice by the mayor of my village and some neighbors
beacuse of my hobby. It has been the worst ham radio period for me and my
parents. But, since I did everything respecting the law, I won all cases. As I
was a law student, all this has been a « good » practice for me, and made me
specialized in administrative and urbanism French law.

Hej Sten,
Never give up!

New Berlin, Wis!
Lilla värld - utom då vi sitter borta och undrar hur vi skall komma hem... eller sitter hemma och tittar på Köpenhamn, men inte får åka dit, hi! 73! Sten
