Yes it is coordinated, OO refused to do anything, coordinating body refused as it was not another repeater, FCC sees amateur radio as self policing and an amateur coordination authority does not have the same weight as it does in LMR or PSB. 

At the end of the day no one is doing anything about the problem and tells me it is all legal as long as they ID every 10 minutes. 

So all you folks that live in metro areas that tie up 2 meter channels with hours of HF traffic consider the problems this causes for the rest of us that are trying to use the same spectrum for its intended purpose. Sky commander and other similar devices tie up frequencies for hours with no breaks rebroadcasting comms from other channels. In my case the Sky command broadcast covers a 20 mile radius and effectively reduces the coverage of the coordinated repeater to less than 5 miles. 

Why this is allowed on amateur is a mystery to me.

Did you send a letter to Laura Smith, the FCC Enforcement Attorney for Amateur Radio, or did you just "assume" that "...amateur radio is self-policing ..." and won't do anything?

Of course, the Official Observer refusing to act is a problem, as most of the FCC's enforcement actions against offending hams do arise from OOs' reports initially.  And, yes, the ARRL and others have convinced the FCC to a certain degree that "...amateur radio is self-policing," to the detriment of the hobby, IMHO, and I have so informed ARRL Section Managers, and Division Directors at hamfests, etc., every chance I get.

But, if it were me personally, I would not give up until I wrote to Laura Smith and got a reply back from her, one way or the other.

Not really chest thumping offender knows nothing will happen and does not care really simple. He was on vacation for 2 weeks last year and left the system up and running the whole time.

The impacted repeater is part of a volunteer program and paid for by a local agency. Volunteers are really put off by this behavior and we have spent more money moving to non ham frequencies to get around the problem.

If the repeater owner has notified the offending user that he is no longer allowed to use the machine and the problem persists, then the user is in violation of the law.  Sure, there are few teeth to the law, but the FCC has been known to take action in such instances in recent times.

As posted originally, the offending ham is not "using" the repeater, he is transmitting on the output frequency of the repeater using his Sky Command set-up, according to the original poster.

Thus the repeater is not being "keyed-up," but legitimate QSOs through the repeater are being interfered with by the offender transmitting on the output frequency of the repeater.

Of course, the repeater Trustee could still complain, but apparently complaints are being ignored.

Since the "offender" is operating a repeater of sorts, he should really have his operations coordinated. Has anyone contacted the "offender" to educate and assist? Email, letter, or gone up to his house and knocked on his door with a "we're here and want to help" positive attitude?

Normally when there is a conflict, the first step should be an attempt of direct dialog, versus immediately "calling the law", sending in SWAT, etc. Issues are best resolved at the lowest level.

If the repeater owner has notified the offending user that he is no longer allowed to use the machine and the problem persists, then the user is in violation of the law.  Sure, there are few teeth to the law, but the FCC has been known to take action in such instances in recent times.

Not really chest thumping offender knows nothing will happen and does not care really simple. He was on vacation for 2 weeks last year and left the system up and running the whole time.

The impacted repeater is part of a volunteer program and paid for by a local agency. Volunteers are really put off by this behavior and we have spent more money moving to non ham frequencies to get around the problem.

Yes it is
coordinated, OO refused to do anything, coordinating body
refused as it was not another repeater, FCC sees amateur
radio as self policing and an amateur coordination authority
does not have the same weight as it does in LMR or
PSB. 
At the end of the day
no one is doing anything about the problem and tells me it
is all legal as long as they ID every 10
minutes. 
So all you
folks that live in metro areas that tie up 2 meter channels
with hours of HF traffic consider the problems this causes
for the rest of us that are trying to use the same spectrum
for its intended purpose. Sky commander and other similar
devices tie up frequencies for hours with no breaks
rebroadcasting comms from other channels. In my case the Sky
command broadcast covers a 20 mile radius and effectively
reduces the coverage of the coordinated repeater to less
than 5 miles. 
Why this is allowed
on amateur is a mystery to me.

  As posted originally, the offending ham is not "using" the repeater, he is transmitting on the output frequency of the repeater using his Sky Command set-up, according to the original poster.

Thus the repeater is not being "keyed-up," but legitimate QSOs through the repeater are being interfered with by the offender transmitting on the output frequency of the repeater.

Of course, the repeater Trustee could still complain, but apparently complaints are being ignored.

  If the repeater owner has notified the offending user that he is no longer allowed to use the machine and the problem persists, then the user is in violation of the law.  Sure, there are few teeth to the law, but the FCC has been known to take action in such instances in recent times.

The impacted repeater is part of a volunteer program and paid for by a local agency. Volunteers are really put off by this behavior and we have spent more money moving to non ham frequencies to get around the problem.

Yes it is
coordinated, OO refused to do anything, coordinating body
refused as it was not another repeater, FCC sees amateur
radio as self policing and an amateur coordination authority
does not have the same weight as it does in LMR or
PSB. 
At the end of the day
no one is doing anything about the problem and tells me it
is all legal as long as they ID every 10
minutes. 
So all you
folks that live in metro areas that tie up 2 meter channels
with hours of HF traffic consider the problems this causes
for the rest of us that are trying to use the same spectrum
for its intended purpose. Sky commander and other similar
devices tie up frequencies for hours with no breaks
rebroadcasting comms from other channels. In my case the Sky
command broadcast covers a 20 mile radius and effectively
reduces the coverage of the coordinated repeater to less
than 5 miles. 
Why this is allowed
on amateur is a mystery to me.

He was contacted in person and notified by mail. As you suggest starting with a positive approach of finding a simple remedy such as moving his system to a different frequency was never an option as he felt he was not doing anything wrong. Apparently many people agree with him by the lack of action taken.
Sky commander and similar similar are not classified as repeaters and as such do not require coordination.

Normally when there is a conflict, the first step should be an attempt of direct dialog, versus immediately "calling the law", sending in SWAT, etc. Issues are best resolved at the lowest level.

  If the repeater owner has notified the offending user that he is no longer allowed to use the machine and the problem persists, then the user is in violation of the law.  Sure, there are few teeth to the law, but the FCC has been known to take action in such instances in recent times.

Yes it is
coordinated, OO refused to do anything, coordinating body
refused as it was not another repeater, FCC sees amateur
radio as self policing and an amateur coordination authority
does not have the same weight as it does in LMR or
PSB. 
At the end of the day
no one is doing anything about the problem and tells me it
is all legal as long as they ID every 10
minutes. 
So all you
folks that live in metro areas that tie up 2 meter channels
with hours of HF traffic consider the problems this causes
for the rest of us that are trying to use the same spectrum
for its intended purpose. Sky commander and other similar
devices tie up frequencies for hours with no breaks
rebroadcasting comms from other channels. In my case the Sky
command broadcast covers a 20 mile radius and effectively
reduces the coverage of the coordinated repeater to less
than 5 miles. 
Why this is allowed
on amateur is a mystery to me.

That's too bad. Sky Commander does "repeat" signals from one channel to another, and if someone is going to set it up on a PERMANENT basis, then it should be classified as a repeater and be coordinated. For a temporary setup which
does not conflict with others' operations, not so much.

Sounds like the first steps have been exhausted, and a complaint of willful interference to the output of a coordinated repeater should be sent to the FCC enforcement bureau. I guess at some point, you do have to send in the SWAT team.

coordinated, OO refused to do anything, coordinating body
refused as it was not another repeater, FCC sees amateur
radio as self policing and an amateur coordination authority
does not have the same weight as it does in LMR or
PSB. 
At the end of the day
no one is doing anything about the problem and tells me it
is all legal as long as they ID every 10
minutes. 
So all you
folks that live in metro areas that tie up 2 meter channels
with hours of HF traffic consider the problems this causes
for the rest of us that are trying to use the same spectrum
for its intended purpose. Sky commander and other similar
devices tie up frequencies for hours with no breaks
rebroadcasting comms from other channels. In my case the Sky
command broadcast covers a 20 mile radius and effectively
reduces the coverage of the coordinated repeater to less
than 5 miles. 
Why this is allowed
on amateur is a mystery to me.

Fcc has /had no interest and did not consider the willful interference to be an issue as the source of interference was 20 miles away. Myself and several others worked the system and the system failed. If you follow the FCC logs you can see that they go after people when the behavior is outrageous or interference with another type of comms such as LMR. Even then offenders with little fear of the FCC continue even after they have been notified that they are in violation.

  That's too bad. Sky Commander does "repeat" signals from one channel to another, and if someone is going to set it up on a PERMANENT basis, then it should be classified as a repeater and be coordinated. For a temporary setup which
does not conflict with others' operations, not so much.

Sounds like the first steps have been exhausted, and a complaint of willful interference to the output of a coordinated repeater should be sent to the FCC enforcement bureau. I guess at some point, you do have to send in the SWAT team.

As you suggest starting with a positive approach of finding a simple remedy such as moving his system to a different frequency was never an option as he felt he was not doing anything wrong. Apparently many people agree with him by the lack of action taken.

  Since the "offender" is operating a repeater of sorts, he should really have his operations coordinated. Has anyone contacted the "offender" to educate and assist? Email, letter, or gone up to his house and knocked on his door with a "we're here and want to help" positive attitude?

Normally when there is a conflict, the first step should be an attempt of direct dialog, versus immediately "calling the law", sending in SWAT, etc. Issues are best resolved at the lowest level.

  If the repeater owner has notified the offending user that he is no longer allowed to use the machine and the problem persists, then the user is in violation of the law.  Sure, there are few teeth to the law, but the FCC has been known to take action in such instances in recent times.

The impacted repeater is part of a volunteer program and paid for by a local agency. Volunteers are really put off by this behavior and we have spent more money moving to non ham frequencies to get around the problem.
