Both sides in the voluntary manslaughter trial of a white Charlotte police officer in the on duty shooting of a black man agree bad choices led up to the man's death as he looked for help after a car crash. .. snip .. Prosecutor Arden Harris said the bad choices were all made by Kerrick, who had his gun drawn and started shooting before taking any time to figure out what was going on. .. Kerrick, 28, faces up to 11 years in prison if convicted. He was charged just hours after the September 2013 shooting, before black men died during arrests or while in custody in Ferguson, Missouri; North Charleston, South Carolina; and Baltimore, among other places, sparking a national debate on police tactics. .. Testimony was expected to continue Tuesday. Jurors did see a photo of Ferrell face down in handcuffs in a pool of blood, but have not heard from the other officers on the scene and haven't seen the video from dashboard cameras that lawyers for both sides said will support their version of events. At his autopsy, Ferrell's DNA was found on Kerrick's uniform from his neck to his feet and on the slide and trigger of the officer's gun. Kerrick's DNA was under Ferrell's fingernails, Greene said. .. But prosecutors said Ferrell, not thinking straight after the wreck, only started running because he feared for his life when one of the other officers said nothing before training the laser targets from his stun gun at his chest. .. Ferrell fell on Kerrick after he was shot four times, not because he was attacking the officer. The eight additional shots came as Ferrell writhed and tried to crawl to escape, not as he reached for the gun, said Harris, a special deputy attorney general for the state who took over after the local district attorney said his office had a conflict trying Kerrick. .. The other two officers at the scene did not shoot and were not charged. .. "Who polices the police when they do wrong?" Harris asked jurors, picked in a two-week process. "You do." .. Kerrick joined the Charlotte-Mecklenburg Police Department in 2011 after working as an animal control officer. .. A grand jury initially refused to indict Kerrick on the voluntary manslaughter charge in January 2014, but prosecutors sent the case back a week later because the panel was missing four members. California Wildfires Torch 134,000 Acres -- and Counting .. (CNN)Firefighters worked Monday in steep terrain and other rugged conditions to fight California's Rocky Fire, one of nearly two dozen wildfires that have torched more than 134,000 acres of the parched state this year, according to state fire officials. .. That's nearly three times the state's 5-year wildfire average of 48,153 acres for this time of year, according to statistics posted by the California Department of Forestry and Fire Protection, or Cal Fire. .. At 60,000 acres, the Rocky Fire is the largest ongoing blaze. It's led to evacuation orders for more than 13,000 people as it feeds on drought-parched vegetation that hasn't seen fire in many years, according to Cal Fire. .. The fire, which is in Lake, Yolo and Colusa counties northwest of Sacramento, was 12% contained, the agency said. .. "This has been a very fast-moving wildfire, with the dry conditions and the weather not really cooperating with us over the past week," Cal Fire spokesman Daniel Berlant told CNN affiliate KCRA. .. More than 2,900 firefighters, 285 engines, four air tankers and 19 helicopters are involved in that fight, Cal Fire says. .. Compared with the state's top 20 deadliest fires, which have burned 100,000 acres or more of land, "this fire does not compare," spokesman Berlant told CNN. .. But the fire is unique because of the rate it has burned. It chewed through 20,000 acres in about five hours, he said. .. Across the state, nearly 10,000 firefighters are working on 21 fires, officials say. .. Fires big and small .. Cal Fire says most of the fires are more than 60% contained. But damage has been substantial in some cases. Fires in Southern California's San Bernardino County and Northern California's Alpine County have affected nearly 50,000 acres. .. Other fires include the Frog Fire, which has burned about 4,200 acres since Thursday. Lower temperatures, higher humidity and clouds helped firefighters push containment to 20%, according to the national fire tracking website InciWeb. PARIS: Technology to drain heat-trapping CO2 from the atmosphere may slow global warming, but will not reverse climate damage to the ocean on any meaningful timescale, according to research published Monday. .. Last Wednesday, Devon Guisherd shot a Philadelphia Swat officer in the chest before the officer returned fire and killed the 27-year-old. Guisherd had been wanted on murder charges tied to the death of 25-year-old Megan Doto, who was struck by a stray bullet in 2014. Dotos unborn daughter also died in the incident. .. Guisherds death marked the first time this year a person shot by an on-duty Philadelphia police officer died as a result of their injuries. A few years ago, it would have seemed impossible that seven full months could pass before the city hit this milestone. In 2012, 15 people died after being shot by Philadelphia police, according to the departments own records. In 2013, 13 people died. .. But in 2014, this number plunged to four, and in 2015, the city is on pace for even fewer. Police commissioner Charles Ramsey, who has been with the department since 2008, attributes this dramatic reduction to better training, new policies, and a department-wide emphasis on de-escalation. Our officers come into very volatile situations, Ramsey said in an interview with the Guardian. How do you de-escalate those situations so you dont have to use not just deadly force, but force in general? .. According to Ramsey, reality-based training, during which officers are placed into live simulations, is key. Also critical is training frequent enough that officers can react without even thinking about it, it because its just reflex, Ramsey said. .. Ramsey, who was selected by President Obama to co-chair the presidential Task Force on 21st Century Policing earlier this year, is no stranger to overseeing this type of decline in shooting deaths. In 1998, the same year Ramsey took the top cop job in Washington DC, the Washington Post released a scathing five-part series detailing how bad training and lax investigations had left the citys metropolitan police as the deadliest major police force per resident in the 1990s. .. Ramsey asked the Justice Department to investigate and make reform recommendations. As a result, fatal officer-involved shootings fell between 1998 and 2001, from 12 to one. .. Those reforms seem to be standing the test of time, too. According to The Counted, the Guardians ongoing investigation on police killings in 2015, the Washington DC metropolitan police department is the only major city department nationwide not to have had a fatal officer-involved shooting this year, although a transit police officer did fatally wound a man in March. .. But the use of deadly force isnt the only measure of a department. In Washington DC, despite the success of many of his initiatives, Ramseys tenure was marred by a series of mass arrests of protesters. In both 2000 and 2002, DC metropolitan officers improperly rounded up hundreds of anti-IMF and World Bank demonstrators, costing taxpayers over $20m in settlements. .. In Philadelphia, Ramseys reform-minded administration seems vulnerable to decades-old mistrust between many of the citys black residents and the police mistrust recently catalyzed by the now-viral video of an April arrest of 22-year-old Tyree Carroll. .. Carroll was initially stopped by officers for riding his bike the wrong direction on a one-way street. In the video, officers can be seen repeatedly punching and kicking Carroll, and beating him with nightsticks. One officer can be heard yelling tase the motherfucker; another calls Carroll a piece of shit during the altercation. , By the end of the arrest, 26 officers are present on the scene. Before the video ends, one officer appears to angrily toss Carrolls bike to the side of the road. It was later revealed that the officers who arrested Carroll were from the narcotics unit, and police said that 5.3 grams of crack cocaine were found in his possession. The words and behavior of the officer as shown on that video go far beyond the acceptable standards of behavior of a police officer, McGlynn said in the statement. Autopsy results prove that 19-year-old Zachary Hammond was shot from behind by a police officer, according to the lawyer representing the family. This latest police shooting puts South Carolina on pace for the most officer-involved shootings in at least 15 years, the Associated Press reports. .. Zachary Hammond was shot and killed by police on Sunday night during a drug sting operation. Reportedly, Hammond drove his car toward an officer in a fast food restaurant parking lot, which forced the officer to open fire on the teen. The unidentified Seneca police officer claims he feared for his life after seeing Hammond drive his car toward him. .. According to a statement from Oconee County Coroner Karl Addis, autopsy results showed that Hammond was shot twice once in the chest and once in the collarbone. Hammonds parents were skeptical of the police departments claims that their son was shot in self-defense so they hired attorney Eric Bland. Bland also doubted the self-defense claim and has asked the state Attorney General to launch a statewide grand jury investigation into the matter. Upon examining images of the bullet wounds, Bland determined that there was no way that Hammond wasnt shot from behind. .. It is clearly, clearly from the back, Bland said. Buffett Introduction Investors need to read and understand disclosure documents to benefit fully from the protections offered by our federal securities laws. Because many investors are neither lawyers, accountants, nor investment bankers, we need to start writing disclosure documents in a language investors can understand: plain English. The shift to plain English requires a new style of thinking and writing, whether you work at a company, a law firm, or the U.S. Securities and Exchange Commission. We must question whether the documents we are used to writing highlight the important information investors need to make informed decisions. The legalese and jargon of the past must give way to everyday words that communicate complex information clearly. The good news is that more and more companies and lawyers are using plain English and filing documents with the SEC that others can study, use, and improve upon. With the SECs plain English rules in place, every prospectus will have its cover page, summary, and risk factors in plain English. The benefits of plain English abound. Investors will be more likely to understand what they are buying and to make informed judgments about whether they should hold or sell their investments. Brokers and investment advisers can make better recommendations to their clients if they can read and understand these documents quickly and easily. Companies that communicate successfully with their investors form stronger relationships with them. These companies save the costs of explaining legalese and dealing with confused and sometimes angry investors. Lawyers reviewing plain English documents catch and correct mistakes more easily. Many companies have switched to plain English because its a good business decision. They see the value of communicating with their investors rather than sending them impenetrable documents. And as we depend more and more on the Internet and electronic delivery of documents, plain English versions will be easier to read electronically than legalese. The SECs staff has created this handbook to help speed and smooth the transition to plain English. It includes proven tips from those in the private sector who have already created plain English disclosure documents. This handbook reflects their substantial contributions and those of highly regarded experts in the field who were our consultants on this project, Dr. William Lutz at Rutgers University and the firm of Siegel and Gale in New York City. But I hasten to add that the SEC has not cornered the market on plain English advice. Our rules and communications need as strong a dose of plain English as any disclosure document. A person is a who, and a thing is a that. Correct: He is the person who said yes. Incorrect: He is the person that said yes. Use an en-dash to mean through or to: the temperature was 70-80 degrees. Use the word minus in an arithmetic phrase. Correct: Net imports = imports minus exports. Incorrect: Net imports = imports-exports. An em-dash is the length of two hyphens. This guide is based on the GPO manual but includes modifications that reflect current usage. .. The most notable difference from the GPO manual concerns the treatment of numbers. Writing Grants PART ONE: DEVELOPING A GRANT PROPOSAL PART TWO: WRITING THE GRANT PROPOSAL PART ONE: DEVELOPING A GRANT PROPOSAL Preparation A successful grant proposal is one that is well-prepared, thoughtfully planned, and concisely packaged. The potential applicant should become familiar with all of the pertinent program criteria related to the Catalog program from which assistance is sought. Refer to the information contact person listed in the Catalog program description before developing a proposal to obtain information such as whether funding is available, when applicable deadlines occur, and the process used by the grantor agency for accepting applications. Applicants should remember that the basic requirements, application forms, information and procedures vary with the Federal agency making the grant award. .. Individuals without prior grant proposal writing experience may find it useful to attend a grantsmanship workshop. A workshop can amplify the basic information presented here. Applicants interested in additional readings on grantsmanship and proposal development should consult the references listed at the end of this section and explore other library resources. .. INITIAL PROPOSAL DEVELOPMENT .. Developing Ideas for the Proposal .. When developing an idea for a proposal it is important to determine if the idea has been considered in the applicant's locality or State. A careful check should be made with legislators and area government agencies and related public and private agencies which may currently have grant awards or contracts to do similar work. If a similar program already exists, the applicant may need to reconsider submitting the proposed project, particularly if duplication of effort is perceived. If significant differences or improvements in the proposed project's goals can be clearly established, it may be worthwhile to pursue Federal assistance. .. Community Support .. Community support for most proposals is essential. Once proposal summary is developed, look for individuals or groups representing academic, political, professional, and lay organizations which may be willing to support the proposal in writing. The type and caliber of community support is critical in the initial and subsequent review phases. Numerous letters of support can be persuasive to a grantor agency. Do not overlook support from local government agencies and public officials. Letters of endorsement detailing exact areas of project sanction and commitment are often requested as part of a proposal to a Federal agency. Several months may be required to develop letters of endorsement since something of value (e.g., buildings, staff, services) is sometimes negotiated between the parties involved. .. Many agencies require, in writing, affiliation agreements (a mutual agreement to share services between agencies) and building space commitments prior to either grant approval or award. A useful method of generating community support may be to hold meetings with the top decision makers in the community who would be concerned with the subject matter of the proposal. The forum for discussion may include a query into the merits of the proposal, development of a contract of support for the proposal, to generate data in support of the proposal, or development of a strategy to create proposal support from a large number of community groups. .. Identification of a Funding Resource .. A review of the Objectives and Uses and Use Restrictions sections of the Catalog program description can point out which programs might provide funding for an idea. Do not overlook the related programs as potential resources. Both the applicant and the grantor agency should have the same interests, intentions, and needs if a proposal is to be considered an acceptable candidate for funding. .. Once a potential grantor agency is identified, call the contact telephone number identified in Information Contacts and ask for a grant application kit. Later, get to know some of the grantor agency personnel. Ask for suggestions, criticisms, and advice about the proposed project. In many cases, the more agency personnel know about the proposal, the better the chance of support and of an eventual favorable decision. Sometimes it is useful to send the proposal summary to a specific agency official in a separate cover letter, and ask for review and comment at the earliest possible convenience. Always check with the Federal agency to determine its preference if this approach is under consideration. If the review is unfavorable and differences cannot be resolved, ask the examining agency (official) to suggest another department or agency which may be interested in the proposal. A personal visit to the agency's regional office or headquarters is also important. A visit not only establishes face-to-face contact, but also may bring out some essential details about the proposal or help secure literature and references from the agency's library. .. Federal agencies are required to report funding information as funds are approved, increased or decreased among projects within a given State depending on the type of required reporting. Also, consider reviewing the Federal Budget for the current and budget fiscal years to determine proposed dollar amounts for particular budget functions. .. The applicant should carefully study the eligibility requirements for each Federal program under consideration (see the Applicant Eligibility section of the Catalog program description). The applicant may learn that he or she is required to provide services otherwise unintended such as a service to particular client groups, or involvement of specific institutions. It may necessitate the modification of the original concept in order for the project to be eligible for funding. Questions about eligibility should be discussed with the appropriate program officer. .. Deadlines for submitting applications are often not negotiable. They are usually associated with strict timetables for agency review. Some programs have more than one application deadline during the fiscal year. Applicants should plan proposal development around the established deadlines. .. Getting Organized to Write the Proposal .. Throughout the proposal writing stage keep a notebook handy to write down ideas. Periodically, try to connect ideas by reviewing the notebook. Never throw away written ideas during the grant writing stage. Maintain a file labeled "Ideas" or by some other convenient title and review the ideas from time to time. The file should be easily accessible. The gathering of documents such as articles of incorporation, tax exemption certificates, and bylaws should be completed, if possible, before the writing begins. .. REVIEW .. Criticism .. At some point, perhaps after the first or second draft is completed, seek out a neutral third party to review the proposal working draft for continuity, clarity and reasoning. Ask for constructive criticism at this point, rather than wait for the Federal grantor agency to volunteer this information during the review cycle. For example, has the writer made unsupported assumptions or used jargon or excessive language in the proposal? .. Signature .. Most proposals are made to institutions rather than individuals. Often signatures of chief administrative officials are required. Check to make sure they are included in the proposal where appropriate. .. Neatness .. Proposals should be typed, collated, copied, and packaged correctly and neatly (according to agency instructions, if any). Each package should be inspected to ensure uniformity from cover to cover. Binding may require either clamps or hard covers. Check with the Federal agency to determine its preference. A neat, organized, and attractive proposal package can leave a positive impression with the reader about the proposal contents. .. Mailing .. A cover letter should always accompany a proposal. Standard U.S. Postal Service requirements apply unless otherwise indicated by the Federal agency. Make sure there is enough time for the proposals to reach their destinations. Otherwise, special arrangements may be necessary. Always coordinate such arrangements with the Federal grantor agency project office (the agency which will ultimately have the responsibility for the project), the grant office (the agency which will coordinate the grant review), and the contract office (the agency responsible for disbursement and grant award notices), if necessary. .. PART TWO: WRITING THE GRANT PROPOSAL .. The Basic Components of a Proposal .. There are eight basic components to creating a solid proposal package: (1) the proposal summary; (2) introduction of organization; (3) the problem statement (or needs assessment); (4) project objectives; (5) project methods or design; (6) project evaluation; (7) future funding; and (8) the project budget. The following will provide an overview of these components. .. The Proposal Summary: Outline of Project Goals .. The proposal summary outlines the proposed project and should appear at the beginning of the proposal. It could be in the form of a cover letter or a separate page, but should definitely be brief -- no longer than two or three paragraphs. The summary would be most useful if it were prepared after the proposal has been developed in order to encompass all the key summary points necessary to communicate the objectives of the project. It is this document that becomes the cornerstone of your proposal, and the initial impression it gives will be critical to the success of your venture. In many cases, the summary will be the first part of the proposal package seen by agency officials and very possibly could be the only part of the package that is carefully reviewed before the decision is made to consider the project any further. .. The applicant must select a fundable project which can be supported in view of the local need. Alternatives, in the absence of Federal support, should be pointed out. The influence of the project both during and after the project period should be explained. The consequences of the project as a result of funding should be highlighted. .. Introduction: Presenting a Credible Applicant or Organization .. The applicant should gather data about its organization from all available sources. Most proposals require a description of an applicant's organization to describe its past and present operations. Some features to consider are: A brief biography of board members and key staff members. The organization's goals, philosophy, track record with other grantors, and any success stories. The data should be relevant to the goals of the Federal grantor agency and should establish the applicant's credibility. .. The Problem Statement: Stating the Purpose at Hand .. The problem statement (or needs assessment) is a key element of a proposal that makes a clear, concise, and well-supported statement of the problem to be addressed. The best way to collect information about the problem is to conduct and document both a formal and informal needs assessment for a program in the FF-4 11-08 target or service area. The information provided should be both factual and directly related to the problem addressed by the proposal. Areas to document are: The purpose for developing the proposal. The beneficiaries -- who are they and how will they benefit. The social and economic costs to be affected. The nature of the problem (provide as much hard evidence as possible). How the applicant organization came to realize the problem exists, and what is currently being done about the problem. The remaining alternatives available when funding has been exhausted. Explain what will happen to the project and the impending implications. Most importantly, the specific manner through which problems might be solved. Review the resources needed, considering how they will be used and to what end. .. There is a considerable body of literature on the exact assessment techniques to be used. Any local, regional, or State government planning office, or local university offering course work in planning and evaluation techniques should be able to provide excellent background references. Types of data that may be collected include: historical, geographic, quantitative, factual, statistical, and philosophical information, as well as studies completed by colleges, and literature searches from public or university libraries. Local colleges or universities which have a department or section related to the proposal topic may help determine if there is interest in developing a student or faculty project to conduct a needs assessment. It may be helpful to include examples of the findings for highlighting in the proposal. .. Project Objectives: Goals and Desired Outcome .. Program objectives refer to specific activities in a proposal. It is necessary to identify all objectives related to the goals to be reached, and the methods to be employed to achieve the stated objectives. Consider quantities or things measurable and refer to a problem statement and the outcome of proposed activities when developing a well-stated objective. The figures used should be verifiable. Remember, if the proposal is funded, the stated objectives will probably be used to evaluate program progress, so be realistic. There is literature available to help identify and write program objectives. .. Program Methods and Program Design: A Plan of Action .. The program design refers to how the project is expected to work and solve the stated problem. Sketch out the following: .. The activities to occur along with the related resources and staff needed to operate the project(inputs). .. A flow chart of the organizational features of the project. Describe how the parts interrelate, where personnel will be needed, and what they are expected to do. Identify the kinds of facilities, transportation, and support services required (throughputs). .. Explain what will be achieved through 1 and 2 above (outputs); i.e., plan for measurable results. Project staff may be required to produce evidence of program performance through an examination of stated objectives during either a site visit by the Federal grantor agency and or grant reviews which may involve peer review committees. .. It may be useful to devise a diagram of the program design. For example, draw a three column block. Each column is headed by one of the parts (inputs, throughputs and outputs), and on the left 11-08 FF-5 (next to the first column) specific program features should be identified (i.e., implementation, staffing, procurement, and systems development). In the grid, specify something about the program design, for example, assume the first column is labeled inputs and the first row is labeled staff. On the grid one might specify under inputs five nurses to operate a child care unit. The throughput might be to maintain charts, counsel the children, and set up a daily routine; outputs might be to discharge 25 healthy children per week. This type of procedure will help to conceptualize both the scope and detail of the project. .. Wherever possible, justify in the narrative the course of action taken. The most economical method should be used that does not compromise or sacrifice project quality. The financial expenses associated with performance of the project will later become points of negotiation with the Federal program staff. If everything is not carefully justified in writing in the proposal, after negotiation with the Federal grantor agencies, the approved project may resemble less of the original concept. Carefully consider the pressures of the proposed implementation, that is, the time and money needed to acquire each part of the plan. A Program Evaluation and Review Technique (PERT) chart could be useful and supportive in justifying some proposals. .. The remaining alternatives available when funding has been exhausted. Explain what will happen to the project and the impending implications. .. Highlight the innovative features of the proposal which could be considered distinct from other proposals under consideration. .. Whenever possible, use appendices to provide details, supplementary data, references, and information requiring in-depth analysis. These types of data, although supportive of the proposal, if included in the body of the design, could detract from its readability. .. Appendices provide the proposal reader with immediate access to details if and when clarification of an idea, sequence or conclusion is required. Time tables, work plans, schedules, activities, methodologies, legal papers, personal vitae, letters of support, and endorsements are examples of appendices. .. Evaluation: Product and Process Analysis .. The evaluation component is two-fold: (1) product evaluation; and (2) process evaluation. Product evaluation addresses results that can be attributed to the project, as well as the extent to which the project has satisfied its desired objectives. Process evaluation addresses how the project was conducted, in terms of consistency with the stated plan of action and the effectiveness of the various activities within the plan. .. Most Federal agencies now require some form of program evaluation among grantees. The requirements of the proposed project should be explored carefully. Evaluations may be conducted by an internal staff member, an evaluation firm or both. The applicant should state the amount of time needed to evaluate, how the feedback will be distributed among the proposed staff, and a schedule for review and comment for this type of communication. Evaluation designs may start at the beginning, middle or end of a project, but the applicant should specify a start-up time. It is practical to submit an evaluation design at the start of a project for two reasons: .. Convincing evaluations require the collection of appropriate data before and during program operations; and, .. If the evaluation design cannot be prepared at the outset then a critical review of the program design may be advisable. .. Even if the evaluation design has to be revised as the project progresses, it is much easier and cheaper to modify a good design. If the problem is not well defined and carefully analyzed for cause and effect relationships then a good evaluation design may be difficult to achieve. Sometimes a pilot study is needed to begin the identification of facts and relationships. Often a thorough literature search may be sufficient. .. Evaluation requires both coordination and agreement among program decision makers (if known). Above all, the Federal grantor agency's requirements should be highlighted in the evaluation design. Also, Federal grantor agencies may require specific evaluation techniques such as designated data formats (an existing FF-6 11-08 information collection system) or they may offer financial inducements for voluntary participation in a national evaluation study. The applicant should ask specifically about these points. Also, consult the Criteria For Selecting Proposals section of the Catalog program description to determine the exact evaluation methods to be required for the program if funded. .. Future Funding: Long-Term Project Planning .. Describe a plan for continuation beyond the grant period, and/or the availability of other resources necessary to implement the grant. Discuss maintenance and future program funding if program is for construction activity. Account for other needed expenditures if program includes purchase of equipment. .. The Proposal Budget: Planning the Budget .. Funding levels in Federal assistance programs change yearly. It is useful to review the appropriations over the past several years to try to project future funding levels (see Financial Information section of the Catalog program description). .. However, it is safer to never anticipate that the income from the grant will be the sole support for the project. This consideration should be given to the overall budget requirements, and in particular, to budget line items most subject to inflationary pressures. Restraint is important in determining inflationary cost projections (avoid padding budget line items), but attempt to anticipate possible future increases. .. Some vulnerable budget areas are: utilities, rental of buildings and equipment, salary increases, food, telephones, insurance, and transportation. Budget adjustments are sometimes made after the grant award, but this can be a lengthy process. Be certain that implementation, continuation and phase-down costs can be met. Consider costs associated with leases, evaluation systems, hard/soft match requirements, audits, development, implementation and maintenance of information and accounting systems, and other long-term financial commitments. .. A well-prepared budget justifies all expenses and is consistent with the proposal narrative. Some areas in need of an evaluation for consistency are: (1) the salaries in the proposal in relation to those of the applicant organization should be similar; (2) if new staff persons are being hired, additional space and equipment should be considered, as necessary; (3) if the budget calls for an equipment purchase, it should be the type allowed by the grantor agency; (4) if additional space is rented, the increase in insurance should be supported; (5) if an indirect cost rate applies to the proposal, the division between direct and indirect costs should not be in conflict, and the aggregate budget totals should refer directly to the approved formula; and (6) if matching costs are required, the contributions to the matching fund should be taken out of the budget unless otherwise specified in the application instructions. .. It is very important to become familiar with Government-wide circular requirements. The Catalog identifies in the program description section (as information is provided from the agencies) the particular circulars applicable to a Federal program, and summarizes coordination of Executive Order 12372, "Intergovernmental Review of Programs" requirements in Appendix I. The applicant should thoroughly review the appropriate circulars since they are essential in determining items such as cost principles and conforming with Government guidelines for Federal domestic assistance. .. .. The staff of the Division of Undergraduate Education (DUE) at the National Science Foundation (NSF) often provide informal guidance to proposers. Staff members give workshops on proposal writing, answer questions by phone and e-mail, and talk to potential awardees at professional meetings and at NSF. The following is the essence of the advice often given to inquirers. These suggestions for improving proposals were collected from a variety of sources, including NSF Program Directors, panel reviewers, and successful grantees. Ultimately, most proposals are peer reviewed in panels consisting of colleagues in science, technology, engineering, and mathematics disciplines or related fields, and the success in obtaining funding depends in great measure on reviewers' judgments and their written reviews. .. While this Guide may provide valuable information for proposal writing in general, it was specifically prepared for programs in DUE. Because programs, priorities, technologies, funding levels, and many other details change, advice in this Guide will also change with time. Following the advice given here certainly does not guarantee funding although we hope it will help applicants write better and more competitive proposals. Another factor that must be considered is that NSF receives many more proposals that are worthy of funding than there are funds to support. National priorities and the desire for a balanced portfolio of projects influence what is ultimately funded. .. We hope that you find this Guide informative. NSF, together with creative partners, makes an important difference in undergraduate science, technology, engineering, and mathematics education. .. "What makes a good proposal?" A good proposal stems from a good concept. The best proposals are those to which the reviewers respond, "Of course, I wish I had thought of that!" .. The most important thing is a project that will benefit undergraduate education and directly improve student opportunities to learn. That said, however, the proposal must be written in sufficient detail to allow reviewers to understand: o what the project hopes to accomplish; o if the project personnel have the necessary expertise to accomplish the goals and objectives; o the potential of the project to improve undergraduate education; o the national impact and cost effectiveness of the project; and o evaluation and dissemination plans. .. Carefully read the Program Solicitation or Announcement (both defined below). The Program Solicitation or Announcement gives the most current information available. For the relevant program it provides, (a) a rationale, (b) an overview, (c) detailed program information, (d) instructions for preparing and submitting proposals, and (e) special review criteria, if any. .. This is the best possible guide for preparing a proposal for a DUE program and should be read carefully and followed precisely. There are no hidden agendas. Proposals are funded in a competitive system based on merit. .. Program Announcements .. The term "program announcement" includes formal NSF publications that announce NSF Programs. Program announcements utilize the generic eligibility and proposal preparation guidelines specified in the Grant Proposal Guide and incorporate the National Science Board (NSB) approved merit review criteria (intellectual merit and broader impacts). These funding opportunities do not specify additional award conditions or reporting requirements, and do not require specific cost sharing beyond the required statutory (1%) amount. .. Proposals submitted in response to program announcements are considered "unsolicited." This means that the resulting awards are subject to the statutory cost sharing requirement. .. Program Solicitations .. Program solicitations are used to encourage the submission of proposals in specific program areas of interest to NSF. They generally are more focused than program announcements, normally apply for a limited period of time, and include specific proposal due dates. Competition among proposals is more precisely defined than with program announcements. .. When a program solicitation is used, the proposals received compete directly with each other. Accordingly, programs using solicitations will be responsible for systematic evaluation, including comparative analysis of scientific, educational, and/or technical aspects, cost, and other significant factors within all proposals in accordance with the criteria specified in the program solicitation. .. Proposals submitted in response to program solicitations are considered "solicited". This means that the resulting awards are not subject to the statutory cost sharing requirement. First, written opinions communicate a courts conclusions and the reasons for them to the parties and their lawyers. .. Second, when published, opinions announce the law to judges, academics, other lawyers, and the interested public. .. Finally, the preparation of a written opinion imposes intellectual discipline on the author, requiring the judge to clarify his or her reasoning and assess the sufficiency of precedential support for it. .. The opinion should fairly, clearly, and accurately state the significant facts and relevant rules of law and demonstrate by its analysis the reasonableness of its conclusions. Misstating significant facts or authorities is a mark of carelessness, and it undermines the opinions authority and integrity. Unclear or ambiguous writing reflects the authors lack of clear thinking and defeats the opinions purpose. .. This manual is intended to encourage judges and law clerks to think critically about their writingnot only about what to include and what to exclude, but also about how to write well. We expect that newly appointed judges and their law clerks will be the principal users of this manual. It therefore takes a functional approach to opinion writing: describing the considerations that arise at each stage of the writing and editing process; recommending organizational and stylistic techniques; and explaining the reasons for its recommendations. In keeping with the principle that there is no single right way to write an opinion, the manual explores alternatives and the considerations for choosing among them. .. This manual should also help experienced judges take a fresh look at their approaches to writing and their styles. Professor Robert Leflar wrote: .. Pride of authorship is by no means an unmitigated evil. . . . [T]his pride can drive a man to hard work and with meticulous effort. The poorest opinions are apt to be written by judges who take no pride in them, who regard the preparation of them as mere chores. Pride in work well done is a proper incident of good craftsmanship in any field of work, including law. An opinion in which the author takes no pride is not likely to be much good.1 .. II. Determining the Scope of the Opinion .. A judicial opinion informs parties of the outcome of their case and articulates the legal principles on which the decision is based in order to guide the bench, the bar, academia, and the public. Because written decisions serve both case-deciding and law-making functions, they range in form from one-sentence, unpublished summary orders to formally structured, citation-laden, full-dress opinions. An opinion that is intended only to inform the parties of the outcome of their dispute should not be as elaborate as one intended to serve as a precedent. .. Before beginning to write, judges should decide what purpose the opinion will serve and how to write it to suit that purpose. .. Three types of decisions .. This manual will refer to three types of written decisions: full-dress opinions, memorandum opinions, and summary orders. .. Full-dress opinions are those that present a structured discussion of the facts, legal principles, and governing authorities involved in a case. The significance or number of the issues presented in a case, the novelty of the question it poses, and the complexity of the facts are among the factors that determine whether an opinion requires fulldress treatment. .. Memorandum opinions are appropriate if the decision does not require a comprehensive, structured explanation but still needs some explanation of the rationale. They are generally brief and informal and may or may not be published. Per curiam opinions are generally included in this category. Appendix A contains an example of a memorandum opinion. .. Summary orders simply state the disposition of the case. They sometimes include a brief statement of findings and conclusions, but often provide little or no explanation. Summary orders are usually unpublished. Appendix B contains an example of a summary order. .. The next section discusses some of the factors a judge should consider in determining what kind of opinion to write. Factors to consider .. Three factors influence the scope and style of an opinion: the complexity of the facts and nature of the legal issues, the intended audience, and whether the opinion will be published. Although the manual addresses these factors separately, they are interrelated. .. Facts and issues .. The complexity of the facts and the nature of the legal issues are the principal factors that determine the kind of opinion required. If the precedents are clear and the material facts are not complicated, the scope of the opinion will be limited. If the controlling law is uncertain or the material facts are complex, exposition and analysis are needed to explain the reasons for the courts decision. Some cases that present complex fact patterns may require lengthy discussion of the facts even though the applicable law may be simple. Other cases that raise novel legal issues may require extended analysis of law and policy. .. The scope of an opinion will be influenced by how well developed the law is on the matter at issue. Judges should consider whether the issue has previously been decided authoritatively and whether another opinion would aid in the development or explanation of the law. If the issue has been thoroughly discussed in prior opinions, the judge need not trace the origins of the law or elaborate on its interpretation. .. In some cases, it is sufficient to affirm a decision for the reasons stated by the court below. If the decision merely closes a gap in existing law, little more is needed than an explanation of the applicable principles and the reasons for the courts choice among them. If, however, the decision contributes to the development of the law, a brief, published per curiam or memorandum opinion is appropriate. A summary order may be sufficient if clear existing law is simply being applied to facts that are undisputed or that are made indisputable on appeal because, for example, they are jury findings supported by substantial evidence. .. When, however, an opinion involves less developed areas of the law and lays down a new rule or modifies an old one, the judge must think not only about the decisions rationale but also about its impact as precedent. The judge should discuss and analyze the precedents in the area, the new direction the law is taking, and the effect of the decision on existing law. Even if it appears that the litigants do not need a detailed statement of the facts, the opinion should present sufficient facts to define for other readers the precedent it creates and to delineate its boundaries. The relevant precedentsand the relevant policiesshould be analyzed in sufficient detail to establish the rationale for the holding. .. Audience .. Opinions are written primarily for the litigants and their lawyers, and for the lower courts or agencies whose decisions they review. If an opinion is addressed to the parties, it should provide them with a fair and accurate statement of what was before the court for decision, what the court decided, and what the reasons for the decision were. .. This can generally be accomplished without a full-dress opinion. The parties will be familiar with the facts and will generally not be interested in an extensive exploration of the law, other than what is needed to give the losing party a clear explanation for the result. The judge must also ask whether the opinion has something to say to others besides the parties. Opinions intended to inform other audiences may require additional factual development and legal analysis. .. How much analysis is required, and how detailed it must be, depends on the subject matter and the probable audience. Judges may assume a certain level of familiarity with the law on the part of lawyers. But if a case involves an arcane area of law familiar primarily to specialists tax, labor, or antitrust law, for examplea thorough discussion of the facts and legal background will be needed, and the judge should avoid the use of technical language and should define any technical terms that must be used. .. An opinion remanding a case must tell the lower court what is expected on remand. An opinion that sets guidelines for trial courts to follow must state the factual basis, legal rationale, and policy foundation of the guidelines sufficiently so that trial judges can apply them correctly. .. The judge needs to consider whether a statement of facts and legal analysis that adequately explain the decision to the parties will also enable a higher court to understand the basis for the decision. When the decision is based on complex facts, a more elaborate explanation than is necessary for the parties may be helpful to the appellate court. .. And when the decision involves novel issues or an emerging area of law, it is appropriate to trace the prior development of the law and to explain the legal and policy rationales at some length. Opinions should not, however, be turned into briefs or vehicles for advocacy. Members of the general public will rarely read opinions. But reporters from the media will communicate what they believe to be the substance of an opinion that strikes them as being of public interest. When an opinion addresses an issue of general public interest or is likely to attract media attention, it should be written in a manner that will ensure it cannot be misunderstood. The mark of a well-written opinion is that it is comprehensible to an intelligent layperson. .. Publication .. The courts of appeals have adopted rules, internal operating procedures, and other policies concerning publication and non-publication of opinions. Some of the policies specify criteria for determining whether an opinion should be published. For example, D.C. Circuit Rule 36(c)(2) establishes the following publication criteria: An opinion, memorandum, or other statement explaining the basis for this courts action in issuing an order or judgment will be published if it meets one or more of the following criteria: (A) with regard to a substantial issue it resolves, it is a case of first impression or the first case to present the issue in this court; (B) it alters, modifies, or significantly clarifies a rule of law previously announced by the court; (C) it calls attention to an existing rule of law that appears to have been generally overlooked; (D) it criticizes or questions existing law; (E) it resolves an apparent conflict in decisions within the circuit or creates a conflict with another circuit; (F) it reverses a published agency or district court decision, or affirms a decision of the district court upon grounds different from those set forth in the district courts published opinion; (G) it warrants publication in light of other factors that give it general public interest. .. Similar criteria are included in First Circuit Rule 36(b)(1); Fourth Circuit Rule 36(a); Fifth Circuit Rule 47.5.1; Sixth Circuit Internal Operating Procedure 32.1(b); Ninth Circuit Rule 36-2; and Federal Circuit Internal Operating Procedure 10. .. Other circuits have more general guidelines, giving judges latitude to decide whether to publish opinions. The Third Circuit, for example, has two forms of opinions: precedential and not precedential, and [p]recedential opinions are posted on the courts internet website.3 .. The Second Circuit permits disposition by summary order [w]hen a decision in a case is unanimous and each panel judge believes that no jurisprudential purpose is served by an opinion . . . .4 Otherwise, written opinions, including per curiam opinions, are published.5 .. In the district courts, the decision to publish is entirely in the judges discretion. (Note, however, that some legal publishers, including Westlaw, put certain district court orders and opinions on line whether or not the judge designates them for publication and even sometimes when a judge states that the order or opinion is not for publication or not to be cited. The publishers base their decision on whether they think that the order or opinion is significant or otherwise of interest.) Because decisions of district judges are merely persuasive authoritythat is, they are not binding precedent even in their own districtspublication of such decisions should be the exception. In addition, time constraints argue against writing formal opinions unless the decision involves a novel or complex issue or a matter of public importance and thus may be useful to attorneys and judges or be of interest to the public. .. Because unpublished decisions are written primarily for the parties, they will require little or no elaboration of the facts and law. Often they will take the form of summary orders or memorandum opinions. The determination as to whether a disposition should be published or unpublished should be made as soon as possible, so that the judge who writes the opinion will not spend an undue amount of time on it if publication is not warranted. .. .. Sandra Bland was pulled over in her car on July 10 by a white state trooper, Brian Encinia, for failing to signal a lane change. The discovery of the 28-year-old's body on July 13 with a trash bag around her neck provoked suspicions of racist treatment, but a senior local official said video footage indicated she was not mistreated in jail. .. Bland's case follows the death of several black men in encounters with white police officers that have led to increased accusations of brutality against minorities. .. The traffic stop escalated into a verbal altercation when Encinia asked Bland to put out a cigarette and she refused. Bland was arrested and charged with assaulting an officer. .. The Associated Press said it had obtained Encinia's personnel file through a public records request. .. In case there was any doubt that money in the presidential campaign has reached unprecedented levels, filings with the Federal Election Commission made it clear how important millionaires and billionaires have become to the process of electing a commander in chief. And the numbers are mighty depressing. The 67 biggest donors, each of whom gave $1 million or more, donated more than three times as much as the 508,000 smallest donors combined, reports Politico. These 67 donors gave a whopping $128 million in cold hard cash to super PACs that support specific presidential candidates. .. Overall, super PACs have raised $271 million from 9,500 donors. To put that number in perspective, super PACs spent $374 million during the entire 2012 campaign cycle and were not even in the primaries yet. At this point in 2011, only one of the 12 Republican contenders had a super-PAC. That was Mitt Romney, whose super-PAC's $12 million haul was less than the $18 million raised by his official campaign at that point, notes Bloomberg. .. And the big money is bigger than ever. In 2012, a mere six Republicans donated $5 million or more over the course of the entire campaign cycle.
