Licensing Division

 

The Licensing Division is responsible for helping to administer the various statutory 
licenses and similar provisions, including: secondary transmissions of radio and television 
programs by cable and satellite systems; making and distributing phonorecords of 
nondramatic musical works; and importing, manufacturing, and distributing digital 
audio recording devices or media.

 

In general the division deducts its full operating costs from the royalty fees collected 
and invests the balance in interest-bearing securities with the U.S. Treasury for later 
distribution to copyright owners (see Report of Receipts). The division also collects 
filing fees to cover part of the costs in administering the cable and satellite licenses.

Organization of the Division

 

The Examining Section examines licensing documents submitted for a statutory or compulsory 
license to determine that they meet the requirements under the statute and Copyright Office 
regulations, including correct computations of the filing and royalty fees. A licensing examiner 
will notify a licensee to correct errors or omissions on a document before final processing by 
the Copyright Office.

 

The Fiscal Section performs all accounting, budgeting, and investing functions of the division 
in conjunction with the Office of the Chief Financial Officer of the Library of Congress and 
the U. S. Treasury. This section is also responsible for the ascertainment of funds available for 
distribution by Copyright Royalty Judges.

 

The Information Section provides information about the compulsory and statutory licenses, 
maintains all the division’s official licensing records, and performs reference searches of 
licensing documents for the public and members of Congress. This section is also responsible 
for examining licensing documents submitted for a statutory or compulsory license to determine 
that they meet the requirements under the statute and Copyright Office regulations, including 
the correct computation of the filing and royalty fees.

Righthaven LLC was a copyright holding company founded in early 2010, which entered 
agreements from its partner newspapers after finding that their content had been copied 
to online sites without permission, in order to engage in litigation against the site owners 
for copyright infringement. The lawsuits were heavily criticized by commentators, who 
describe the activity as copyright trolling[1][2] and the company as a "lawsuit factory".

Getty Images, Inc. is a stock photo agency, based in Seattle, Washington, USA. It is a supplier of stock 
images for business and consumers with an archive of 80 million still images and illustrations and more 
than 50,000 hours of stock film footage. It targets three markets-creative professionals (advertising and 
graphic design), the media (print and online publishing), and corporate (in-house design, marketing and 
communication departments).

Getty has distribution offices around the world and capitalizes on the Internet and CD-ROM collections 
for distribution. As Getty has acquired other older photo agencies and archives, it has digitised their 
collections, enabling online distribution. Getty Images now operates a large commercial website which 
allows clients to search and browse for images, purchase usage rights and download images. Costs of 
images vary according to the chosen resolution and type of rights associated with each

image. The company also offers custom photo services for corporate clients.

History

In 1993, Mark Getty and Chief Executive Officer Jonathan Klein co-founded 
Getty Investments LLC. Mark Getty is the company's chairman.

In September 1997, Getty Communications, as it was called at the time, merged 
with PhotoDisc, Inc. to form Getty Images.

 

.

 

In April 2003 Getty Images entered into a partnership with Agence France-Presse 
(AFP) to market each other's images.[1]

 

.

 

Getty Images acquired the Michael Ochs Archives in February 2007.[2] The Michael 
Ochs Archives were described by The New York Times as "the premier source of 
musician photography in the world".[3]

 

In 2008, the private equity firm Hellman & Friedman acquired Getty Images.

In 2009, Flickr announced a partnership with Getty Images in which specially 
selected users could submit photographs for stock photography usage and 
receive payment. In 2010 this was changed so that users could label images 
as suitable for stock use themselves.[4]

Controversial practices to enforce copyright

Getty Images has caused controversy for its aggressive pursuit of

copyright enforcement on behalf of its photographers. Rather than pursue a policy 
of sending out "cease and desist" notices, Getty typically mails out a demand letter 
claiming substantial sums of damages to owners of websites which it believes are using 
their images in infringement of their photographers' copyright.[14] Getty commonly 
tries to intimidate website

owners by sending collection agents, even though a demand letter cannot create a debt. 
One photographer noted: "courts don't like to be used as a means of extortion."[14] 
In one case, Getty sent a church in Lichfield, Staffordshire, a 6,000 bill for photographs 
used on its website, apparently placed there by a church volunteer.[14] In this case, 
the church offered to pay Getty what it thought was a reasonable amount. 
The diocese's communications director said, "Getty was not playing ball or

following the normal litigation or dispute resolution procedures and [I advised the church] 
to ignore them. We don't deal with bullies; we deal with legal threats appropriately. I told 
[Getty] by letter that's what [the church was] doing, that we were not going to play, and 
didn't hear any more."[14] The Guardian describes other instances in which Getty or other 
stock photo businesses dropped the matter when the website owner

refused to pay or hired a lawyer. A law firm was quoted as saying: 

"Once we get involved generally Getty does back off."[14]

  • DATABASES: Stanford's Copyright Renewal Database. 

    "Welcome to the initial release of Stanford's Copyright Renewal Database. This database makes searchable the copyright renewal records received by the US Copyright Office between 1950 and 1992 for books published in the US between 1923 and 1963. Note that the database includes ONLY US Class A (book) renewals.

    The period from 1923-1963 is of special interest for US copyrights, as works published after January 1, 1964 had their copyrights automatically renewed by statute, and works published before 1923 have generally fallen into the public domain. Between those dates, a renewal registration was required to prevent the expiration of copyright, however determining whether a work's registration has been renewed is a challenge. Renewals received by the Copyright Office after 1977 are searchable in an online database, but renewals received between 1950 and 1977 were announced and distributed only in a semi-annual print publication. The Copyright Office does not have a machine-searchable source for this renewal information, and the only public access is through the card catalog in their DC offices.

  • DATABASES: Stanford Copyright Renewal Database 
    "Welcome to the initial release of Stanford's Copyright Renewal Database. This database makes searchable the copyright renewal records received by the US Copyright Office between 1950 and 1992 for books published in the US between 1923 and 1963. Note that the database includes ONLY US Class A (book) renewals.

    The period from 1923-1963 is of special interest for US copyrights, as works published after January 1, 1964 had their copyrights automatically renewed by statute, and works published before 1923 have generally fallen into the public domain. Between those dates, a renewal registration was required to prevent the expiration of copyright, however determining whether a work's registration has been renewed is a challenge. Renewals received by the Copyright Office after 1977 are searchable in an online database, but renewals received between 1950 and 1977 were announced and distributed only in a semi-annual print publication. General: Formative Assessment

As many of you know, formative assessment, in which we check for student understanding along
the way, allows us and our students to identify where they are at on some concept or skill so
that we can adjust our instruction or they can adjust their learning and studying strategies,
as the conversation at the above link illustrates.  Although this was the original purpose
for formative assessment, we now realize that it can do much more.  For example, research has
found that good skill development requires 1) instruction/modeling, 2) practice, 3) feedback,
and 4) reflection.  Formative assessment can provide a good vehicle for addressing each of
the last three steps. In fact, we can apply those four steps to conceptual development as
well, and use formative assessments in that process.  


Furthermore, many of you have likely realized that formative assessments can promote the
strengthening of learning if they encourage forced retrieval, aka, testing effect,
retrieval-based practice, etc.  The examples in the above link describe high-tech and
low-tech tools for checking for understanding.  For example, on the high-tech end, you can
use tools like Socrative.com or Polleverywhere.com to quiz your students through their cell
phones or other electronic devices.   I have used those to review concepts, and students find
them very engaging.  Yet, as the article mentions, the same effect can be captured through
low-tech tools such as having students pointing to different corners of the room to indicate
particular answers, or holding up cards with the corresponding answers.  All of those
examples though are asking for student recognition rather than student recall, limiting the
benefit of forced retrieval.  


So, I am considering a low-tech alternative, and I wanted to get your comments and
suggestions on it for me, mostly:), and for the other subscribers.  At the beginning of the
semester I would hand out 5 laminated cards to each student for them to bring to every class,
and I would collect them at the end of the semester to use again.  Four of the cards would be
about half a sheet of paper in size, each a different color, and each with a different letter
(A, B, C, or D) on it.  The A and B cards would also have YES and NO on them in case I want
to ask those kinds of questions.  These cards would obviously allow me to ask multiple-choice
type review or thought questions.  Students would raise up the card that they believe is the
right answer.  I and other students could quickly see the distribution of answers as we would
all get used to the corresponding colors quickly.  Sometimes I would have them wait a few
seconds until everyone has selected a card to raise them so they aren't just following what
everyone else is saying.  The high-tech tools allow for that as well.


Now for the forced retrieval.  The fifth, laminated card would be the size of a whole piece
of paper, with one side being white and the other side light blue.  Along with this card I
would give every student a dry erase marker at the beginning of the term that they would also
bring to every class.  (I know, that could be problematic.  Or, do I have them purchase one
themselves?)  Then, I could ask recall questions which they would respond to by writing their
answer on the white side of the page.  Again, they would hold up their cards so I could see
if they recalled the information.  (Currently, I tell my students to look at the ceiling on
the second day  of class.  Then I ask them one or more review questions.  I explain that I
had them look at the ceiling so they could not use their notes.  Then I explain the benefits
of forced retrieval.)  Unfortunately, in this case, other students could not easily see what
the rest of the class answered.  However, another thing I thought I could occasionally use
this card for is to have a friendly competition.  At the beginning of class I might have 4 or
5 recall review questions.  I would have all the students stand up.  Students would write
their answer to the first question and hold it up.   After I or another student gave the
correct answer, everyone with the wrong answer would sit down.  Then we could see who could
remain standing for all the questions.  But I don't want to lose the "losers" on subsequent
questions.  So, what I was thinking of doing is that everyone who is sitting down would write
their answer to the next question on the light blue side of the card.  If they got that
question right they could stand back up, until they miss again.  Then they could stand up
again if they got another question right. But they would always use the light blue side once
they missed a question.  Then I could tell the "winners" by those whose answers were written
on the white side.

to search. Many people make the quickest decision: Google! Those
seeking higher quality and more precise results may select Google
Scholar or Google Books.

However, if you have a complex search topic or need
very accurate, targeted results, searching with EBSCOHost
may be a better alternative. This article discusses the
databases provided by EBSCOHost useful in life care planning
