    "Intellectual property (IP) refers to creations of the mind, such as inventions; 
    literary and artistic works; designs; and symbols, names and images used in commerce.

    IP is protected in law by, for example, patents, copyright and trademarks, 
    which enable people to earn recognition or financial benefit from what they invent or create. 
    By striking the right balance between the interests of innovators and the wider public interest, 
    the IP system aims to foster an environment in which creativity and innovation can flourish."

    "Intellectual property (IP) is a legal term that refers to creations of the mind. Examples of 
    intellectual property include music, literature, and other artistic works; discoveries and inventions; 
    and words, phrases, symbols, and designs. Under intellectual property laws, owners of intellectual 
    property are granted certain exclusive rights. Some common types of intellectual property rights (IPR) 
    are copyright, patents, and industrial design rights; and the rights that protect trademarks, trade dress, 
    and in some jurisdictions trade secrets. Intellectual property rights are themselves a form of property, 
    called intangible property.

    Although many of the legal principles governing IP and IPR have evolved over centuries, it was not until 
    the 19th century that the term intellectual property began to be used, and not until the late 20th century 
    that it became commonplace in the majority of the world.[1] The Statute of Monopolies (1624) and the 
    British Statute of Anne (1710) are now seen as the origins of patent law and copyright respectively,
    [2] firmly establishing the concept of intellectual property."

    " It has become fashionable to toss copyright, patents, and trademarks—
    three separate and different entities involving three separate and different 
    sets of laws—plus a dozen other laws into one pot and call it 
    “intellectual property”. The distorting and confusing term did not become 
    common by accident. Companies that gain from the confusion promoted it. 
    The clearest way out of the confusion is to reject the term entirely.

    According to Professor Mark Lemley, now of the Stanford Law School, 
    the widespread use of the term “intellectual property” is a fashion that 
    followed the 1967 founding of the World “Intellectual Property” Organization 
    (WIPO), and only became really common in recent years. (WIPO is formally 
    a UN organization, but in fact represents the interests of the holders of 
    copyrights, patents, and trademarks.) Wide use dates from around 1990.

    The term carries a bias that is not hard to see: it suggests thinking about copyright, 
    patents and trademarks by analogy with property rights for physical objects. 
    (This analogy is at odds with the legal philosophies of copyright law, of patent law, 
    and of trademark law, but only specialists know that.) These laws are in fact not 
    much like physical property law, but use of this term leads legislators to change 
    them to be more so. Since that is the change desired by the companies that exercise 
    copyright, patent and trademark powers, the bias introduced by the term 
    “intellectual property” suits them."

    We currently have 188 member states.

    To become a member, a state must deposit an instrument of ratification or accession 
    with the Director General. The WIPO Convention provides that membership is open 
    to any state that is:

    a member of the Paris Union for the Protection of Industrial Property, or member 
    of the Berne Union for the Protection of Literary and Artistic Works; or
    a member of the United Nations, or of any of the United Nations' Specialized Agencies, 
    or of the International Atomic Energy Agency, or that is a party to the 
    Statute of the International Court of Justice; or invited by the WIPO General Assembly 
    to become a member state of the Organization.

    "We cooperate with intellectual property (IP) offices from around the world to 
    provide our stakeholders with up-to-date IP statistics. We also publish statistical 
    reports on worldwide IP activity and on the use of WIPO-administered treaties in 
    the protection of IP rights internationally.

    Reliable IP statistics are an important tool in understanding trends in business 
    and technology and in the use of the IP system worldwide and across different 
    countries.

    IP data published in these pages are taken from the WIPO Statistics Database. 
    The database contains:

    Data provided by national/regional IP offices for WIPO's Annual IP Data Survey. 
    The data are collected at an aggregate level by various breakdowns (e.g. number 
    of patent filings or grants by office and origin, etc.). A continuing effort is made to 
    improve the quality and availability of IP statistics. It is difficult to obtain data for 
    all IP offices with all possible breakdowns, however every effort is made to cover 
    data for as many offices and countries as possible; and

    Data compiled by WIPO during the application process of international filings 
    through the Patent Cooperation Treaty, the Madrid System and the Hague System.

    In addition, indicators of patent families and fields of technology are developed by 
    WIPO based on data from the PATSTAT database, which is maintained by the 
    European Patent Office.

    IP data reported in these pages are based on the following concepts:

    Country of origin: used to categorize IP data by resident (domestic) and non-resident 
    (foreign). The residence of the first-named applicant (or inventor) recorded in the IP 
    document (e.g. patent or trademark application) is used to classify IP data by country 
    of origin.

    Resident and non-resident: a resident IP filing refers to an application filed by an 
    applicant at its national IP office. For example, an application filed by an applicant 
    resident of Japan at the IP office of Japan is considered as a resident filing for Japan 
    IP office data. Similarly, a non-resident filing refers to an IP application filed by an 
    applicant at a foreign IP office. For example, an application filed at the IP office of 
    China by an applicant residing in France is considered a non-resident filing for China 
    IP office data. The IP grant (registration) data are based on the same concept.
    Filing and grant date: the IP filing data are based on the date of filing. The IP grant 
    (registration) data are based on the date of grant (registration). The IP data by field 
    of technology are based on the date of publication and the patent families data are 
    based on the priority (or first filing) date."

  • DATABASES: Stanford Copyright Renewal Database 



    "Welcome to the initial release of Stanford's Copyright Renewal Database. 
    This database makes searchable the copyright renewal records received 
    by the US Copyright Office between 1950 and 1992 for books published 
    in the US between 1923 and 1963. Note that the database includes 
    ONLY US Class A (book) renewals.

    The period from 1923-1963 is of special interest for US copyrights, as works 
    published after January 1, 1964 had their copyrights automatically renewed by 
    statute, and works published before 1923 have generally fallen into the public 
    domain. Between those dates, a renewal registration was required to prevent 
    the expiration of copyright, however determining whether a work's registration 
    has been renewed is a challenge. Renewals received by the Copyright Office after 
    1977 are searchable in an online database, but renewals received between 
    1950 and 1977 were announced and distributed only in a semi-annual print publication. 
    The Copyright Office does not have a machine-searchable source for this renewal 
    information, and the only public access is through the card catalog in their DC offices.

    In order to make these renewal records more accessible, Stanford has created this 
    searchable database. Building on the work done by Project Gutenberg to transcribe 
    the 1950-1977 renewals, and on early conversion efforts by Michael Lesk, we have 
    converted the published renewal announcements to machine-readable form, and 
    combined them with the renewals for later years made available on the Copyright 
    Office's website. Note that this database covers only renewals, not original registrations, 
    and is limited to books (Class A registrations) published in the US. Note that the 
    Catalog of Copyright Entries, and therefore this database, does not include entries 
    for assignments, and so cannot be used for searches involving the ownership of rights. 
    Please also note that copyrights restored under Section 104(a) of the copyright act are 
    not represented in this database.

    Stanford has performed two rounds of testing in order to assess the accuracy of this 
    database. In each round, we pulled a minimum of 500 book titles published in the 
    US between 1923 and 1963 from the Stanford library catalog. The works were checked 
    manually in the CCE, and, in the first round, a subset of 100 records was also sent to the 
    Copyright Office to be checked by their in-house staff. Each of these items was then 
    separately searched by project staff in the Copyright Renewals Database. In each round, 
    the error rate for the database was found to be less than 1%, although in practice there is 
    significant opportunity for user error or other problems in searching. Details of these issues 
    can be found in Stanford's final report to Hewlett on the project ( PDF), and in the two 
    search results sets ( Search Set #1, Search Set #2).

In response to patent owner and public inquiry, the USPTO is providing a downloadable patent term calculator as a resource to help the public estimate the expiration date of a patent. The calculator can be used to estimate the expiration dates of utility, plant, or design patents. The calculator contains prompts to enter specific information related to the patent in order to help in estimating expiration dates. This information can be obtained from USPTO's online systems, links to which are provided below.

    What is a trademark?

    A trademark is a sign capable of distinguishing the goods or services of one enterprise from those of other enterprises. Trademarks are protected by intellectual property rights.


    How can I protect my trademark? ↓

    At the national/regional level, trademark protection can be obtained through registration, by filing an application for registration with the national/regional trademark office and paying the required fees. At the international level, you have two options: either you can file a trademark application with the trademark office of each country in which you are seeking protection, or you can use WIPO’s Madrid System.

    In principle, a trademark registration will confer an exclusive right to the use of the registered trademark. This implies that the trademark can be exclusively used by its owner, or licensed to another party for use in return for payment. Registration provides legal certainty and reinforces the position of the right holder, for example, in case of litigation.

    The term of trademark registration can vary, but is usually ten years. It can be renewed indefinitely on payment of additional fees. Trademark rights are private rights and protection is enforced through court orders.

    The United States Patent and Trademark Office does not calculate expiration dates for patents. In response to patent owner and public inquiry, the USPTO is providing a downloadable patent term calculator as a resource to help the public estimate the expiration date of a patent. The calculator can be used to estimate the expiration dates of utility, plant, or design patents. The calculator contains prompts to enter specific information related to the patent in order to help in estimating expiration dates. This information can be obtained from USPTO's online systems, links to which are provided below.

This happens automatically on campus at Temple University. 
Off campus, to have access to this feature, one CANNOT go
directly to Google Scholar and use it. One must go to
Temple University Library's list of databases and select 
Google Scholar from that list.  It will facilitate matters if on
the same internet browser, one has already logged into a
Temple proprietary database already. Once one has gone to
Google Scholar via the library database list, the
WEB OF SCIENCE link should appear in Google Scholar
search results.
